The two bodies that oversee the operation and facilitation of the agreement are the Insurance Bureau of Canada (“CBI”) and the Canadian Association of Insurance Administrators (CICMA). While CICMA is responsible for the operation and facilitation of the obligations prescribed under the agreement, IBC is the organization that managed the agreement and is responsible for keeping the list of signatories.1 Insurance Bureau of Canada (IBC) is the national interprofessional organization representing Canada`s private home, auto and business insurers. In addition, I believe that both parties, if they are signatories to the arbitration agreement, have effectively departed from the civil proceedings and that the matter will be resolved in this way. The parties will have clearly and completely withdrawn from the civil proceedings.7 It is not new that the resolution of civil claims is a lengthy and costly process. The retracted judicial system and the costs of participation related to a mandatory procedure that must be followed regularly waste a great deal of time and money, while the procedure and jurisdiction of the court are not necessary to find a solution. It is often in the interest of insurers to resolve under-deized claims defended by insurers without the participation of the courts. The law is very clear: if the parties agree to waive disputes in favour of arbitration, the courts should respect that agreement.

This is not only a contractual agreement on how to deal with dispute resolution, but also to encourage the court to respect such agreements, including the promotion of the use of less jurisdictional resources. What insurance covers most real estate, auto and commercial insurance caused by a storm.
